Terms and conditions

Below are the agreements between you and MakelAI. We have kept them as short and readable as we could. Where something has to be legally precise, it is.

These terms apply from NOG INVULLEN and cover every use of MakelAI.

Who this is about

MakelAI, registered with the Dutch Chamber of Commerce under number NOG INVULLEN, hereafter "we". You are the party creating an account and using the service, hereafter "you".

MakelAI is intended for business use. If you use it as a consumer, your statutory consumer rights apply in full, including where these terms say otherwise.

What we deliver

MakelAI is an online service that uses artificial intelligence to draft property descriptions based on the photos and details you provide.

We do our best to keep the service available, but we do not promise uninterrupted availability. We announce maintenance in advance where we can.

Your account

You are responsible for what happens with your login details. Do not share them.
The details you provide must be accurate.
One account is meant for one user. If you work with several colleagues, get in touch.
Think someone else has access to your account? Tell us straight away.

Credits and subscriptions

One credit equals one property description.
Credits are added at the start of each subscription month.
Unused credits expire at the end of the month and are not paid out.
Having a text rewritten within the same job costs no extra credit.

The free trial month

The trial lasts one month and includes ten credits. You do not need to provide payment details.

The trial ends automatically. Nothing is charged and no subscription starts unless you choose one yourself.

Prices and payment

All prices on the website are in euros and exclude VAT unless stated otherwise.
Payment is in advance, monthly or yearly, through our payment provider.
On a yearly subscription you pay for the full year up front at the lower rate.
If a payment fails we try again. If it keeps failing we may suspend your account.

We may adjust our prices. We give at least 30 days' notice. If you disagree, you can cancel before the new price takes effect.

Cancelling

You can cancel at any time from your account. There is no notice period. Your subscription runs to the end of the period you have already paid for, then stops.

We do not refund a period that has already started, except where the law requires us to.

What you may not do

Use the service for anything unlawful.
Produce texts that discriminate, mislead or cause someone harm.
Attempt to bypass security or scrape the service automatically.
Resell your account, or resell the service under your own name without a written agreement.
Enter third parties' personal data without a lawful basis for doing so.

If you breach this, we may suspend or terminate your account.

Who owns the texts

The property descriptions you create are yours. You may use them commercially, edit them and publish them wherever you like. Including after your subscription ends.

The service itself, the software, the brand and the design remain ours.

A note on copyright. Under Dutch law, a text produced entirely by a machine does not in principle attract copyright. As soon as you edit the text and make your own creative choices, that changes. Another reason to always decide the final version yourself.

The accuracy of the text

This is the most important point on this page, so do read it.

MakelAI produces texts using a language model. Such a model can get things wrong. You are the one publishing the text and you are responsible for what it says. So always check that every fact is right before you put a text online: floor areas, year built, energy label, facilities.

We are not liable for damage arising because a published property description contains an inaccuracy.

Liability

We are only liable for direct damage that is genuinely attributable to us. Our liability is limited to the amount you paid us in the twelve months preceding the damage.

We are not liable for lost revenue, lost instructions, loss of data or consequential damage.

These limitations do not apply in cases of intent or deliberate recklessness on our part.

Changes to these terms

We may amend these terms. We announce a significant change by email at least 30 days in advance. If you do not agree, you can cancel before the change takes effect.

Governing law

These terms are governed by Dutch law. Disputes are submitted to the competent court in NOG INVULLEN, unless the law designates a different court.

Do come and talk to us first. That resolves far more than proceedings do.
